Cops tried to take away my video camera and tape/sd cards?

Well i was driving down the 15fwy heading to Vegas with a couple buddies of mine. We all have pretty modded out cars btw. I have a my video camera mounted in the back seat wear my harness bar near me so it can focus on the road and speedo. I got pulled over for supposedly going 95 in a 65.... we were going around limit since its just a cruise. he asked me how fast i was going, i said 65 maybe 70. He told me BS and said 95. I told him you can even check my video recorder. He said he had to confiscate it. I told him you can take the camera, but leave me the tape and SD card. He told me to shut up or he'll arrest me. He said they are evidence, i said i understand but its my evidence since I'm taking this thing to court.

He then gave me attitude, gave me the ticket and drove off... wtf lol

I caught the whole convo on tape. Of him being a jerk, and me being calm and cooperative
whats the chances of my case being thrown out

I live in California.. CHP pulled me over.. =)
I have a pretty good lawyer had a similar case... when i got a exhibition of speed ticket... without moving....My engine overheated so it was smoking so the cop thought i was burning out lol.
Gotta love them CHP officers

yes i did offer him the camera but the tapes or anything recordable he cannot touch or ask for in a public place...

Well, his attitude needs tuning but you offered the camera as evidence. He can collect it. He could even claim any other tapes in the car at the time even if they were stored in the trunk. Offering evidence is a tricky thing. Many people have offered tapes or files or whatever to clear their names but end up getting burned because of other incriminating evidence that they did not know would be looked at.

As for getting this tossed out, I do not see it really doing much for that. If your camera was going and it shows you were following the speed limit and there was nothing else on the tapes that show you breaking the law then you will probably be found not guilty. Perhaps, they will review the tapes and decide to not even go to court. Getting the ticket tossed because the cop was a jerk is not really something that happens.

Chances of getting thrown out are good ONLY if your tape exonerates you on the speeding. The reason the cop wanted to collect it was because if it is in YOUR hands the tape can be doctored and edited while a tape in police hands gets put in a sealed evidence back and doesn't get tampered with.

Just like there are good cops there are also bad cops and if the video proves you didnt speed he could feel threatened by the fact that he was wrong some people dont like to admit when they are wrong also he has no right to take it only time he could is if a warrent was presented for the tape. it sounds like a strong possibility it will be thrown out make sure you get your lawyer to present the situation to a judge sounds like he was in the wrong a good portion of the time
